Terms of service

1. Agreement
These terms govern use of Clinic Answering Service provided by Radiatus. By creating a workspace or using the Service you accept them on behalf of your organization.
2. Accounts and acceptable use
You are responsible for your users, their credentials and all activity in your workspace. You must not use the Service to send spam, unsolicited marketing in breach of the TCPA or carrier rules, unlawful content, or to store data you have no right to process. We may suspend workspaces that threaten the security or reputation of the platform, with notice where practical.
3. Subscriptions, usage and payment
Plans are billed monthly or yearly in advance. Usage items (extra minutes, additional numbers and locations) are charged at the published rates on the next invoice or from a prepaid wallet balance. Prices exclude applicable taxes (for example US state sales tax). Trials convert to a paid plan only when you choose one; unpaid workspaces become read-only after the trial. See the Refund policy.
4. Your data
You own your customer content. You grant us the rights needed to host, process and back it up to provide the Service. We process personal data under our Privacy policy and, for regulated customers, a Data Processing Agreement or Business Associate Agreement on request. You can export your data at any time.
5. Messaging and telephony
Telecom carriers and the voice and SMS gateway have their own policies and approval processes, including US A2P 10DLC registration for business texting. Number availability, porting and delivery are subject to those providers. You are responsible for obtaining recipient consent and for the content of messages and calls.
HIPAA and the Business Associate Agreement
If your organization is a HIPAA covered entity or business associate, our Business Associate Agreement forms part of these terms and is countersigned before PHI is processed. It is included on every plan at no extra cost. Under it we report breaches of unsecured PHI within 10 business days of discovery, keep the PHI access log for six years, bind every sub-processor that touches PHI to a BAA and return or destroy PHI at termination. If the BAA and these terms conflict on the handling of PHI, the BAA prevails. Trial workspaces are for sample data only; do not enter real PHI before the BAA is signed and your production workspace is set up in the US hosting region. You remain responsible for your Notice of Privacy Practices, for obtaining any patient authorizations you need, and for telling callers that an AI assistant may answer, where your state requires it. Calls and texts are placed in line with the TCPA and your carriers' rules.
Integration and eligibility status
Features described as sandbox, demo or planned on the website (including EHR write-back and the eligibility clearinghouse connection as of October 2026) are not yet production services and are not covered by any service commitment until we confirm them as live for your account in writing. Eligibility results repeat what payers return, are not a guarantee of coverage or payment, and do not replace your staff's verification. The Service never gives medical advice; clinical decisions remain with your licensed professionals.
6. Availability and support
We target 99.9% monthly uptime excluding scheduled maintenance announced in advance. Our team is in Coimbatore, India. Support runs Monday to Friday, 9 am to 5 pm US Eastern Time, by email at info@radiatus.com and phone or WhatsApp at +91-9585160363; urgent incidents are acknowledged within 4 hours at any time. Phone support is included on Practice and Group plans.
7. Intellectual property
The Service, its software and branding belong to Radiatus. You may not copy, reverse-engineer or resell it except under a written partner agreement.
8. Warranty and liability
The Service is provided "as is". To the extent permitted by law, our total liability for any claim is limited to the fees you paid in the 12 months before the claim. We are not liable for indirect or consequential loss. Nothing limits liability for fraud or wilful misconduct. Clinical, financial and quality decisions remain the responsibility of qualified professionals using the Service.
9. Termination
You may cancel any time from Billing settings; service continues to the end of the paid period. We may terminate for breach with 14 days' notice to cure. Data is available for export for 30 days after termination, then deleted.
10. Governing law
These terms are governed by the laws of India with courts in Coimbatore, Tamil Nadu having jurisdiction (US customers of Clinic Answering Service: Delaware law and courts). Contact: info@radiatus.com.
